Child Support Enforcement
The employee earns $500 per week gross and $320 aggregate disposable weekly earnings (ADWE). The employer presently deducts $100 per week for child support from the $320 on an order that limits the withholding to 50 percent of ADWE. The employer receives the National Medical Support Notice (NMSN) that limits the total amount withheld for both current child support and medical support to 50 percent of ADWE. Fifty percent of $320 is $160. The employer is informed by the plan administrator that $30 per week is required to enroll the child(ren) in the health care plan. In this example, the employer will withhold $100 for child support and $30 for health care plan coverage.
Same situation as above, except $70 per week is required to enroll the child(ren) in the health care plan. In this situation, withholding $100 for child support and $70 for family health care plan coverage would exceed 50 percent of the employee's ADWE (i.e., $170 exceeds $160). The employer will follow the NMSN directions and return Part A to Child Support Enforcement, having completed item 4 of the Employer Response to notify the issuing agency that enrollment cannot be completed because of limitations on withholding. The employer will still withhold $100 for child support.
